Terms & Conditions

The T&C outlined in this page is for our class bookings. For T&C of our Digital products, click the button below. 

By enrolling your child in Whimsy & Co. Studio classes, you agree to the following terms and conditions. Our aim is to create a joyful, safe, and respectful space for all children and whānau.

 

Cancellation & Refund

  • Payment is required in full upfront each term to confirm your child’s place.

  • Unfortunately, we are unable to offer full refunds if you choose to cancel your enrolment or miss classes once the term has begun. We may be able to offer partial refunds, discounts or vouchers depending on circumstances. For more information, please contact the Whimsy team at whimsyandcostudio@gmail.com 

  • If we (Whimsy & Co.) need to cancel a class for any reason (e.g., illness, emergency), we will also offer either:

    • a refund for the missed session, or

    • a credit toward your next term.

Illness policy

To keep our studio safe and healthy for all:

  • If your child is unwell, please keep them home.

  • If your child becomes visibly unwell during class, we will contact you and ask that they be collected as soon as possible. 

  • We are not able to offer catch up sessions or refunds for missed classes due to illness, but we appreciate you helping us protect our community by staying home when needed. 

 

Allergy & Medical Information

  • Please inform us of any allergies, medical conditions, or special needs your child has at the time of enrolment.

  • This information helps us create a safe environment and respond quickly in case of an emergency.

  • We cannot be held responsible for reactions if relevant information is not disclosed.

 

Vaccinations

  • We do not require children to be vaccinated in order to attend.

  • However, we ask that you notify us of your child's vaccination status at enrolment. This is solely so we can follow public health guidelines if an outbreak occurs.

 

Behaviour and Safety Policy

  • We strive to maintain a safe, respectful, and positive space for all children.

  • Children are expected to follow teacher instructions and respect peers and studio property.

  • In cases of repeated disruptive behavior, we may discuss with families to find the best way forward, including possible temporary suspension if needed.

  • For safety reasons, running, throwing materials, or unsafe use of tools is not permitted.

 

Device Policy

  • We occasionally take photos during class to capture the creative magic, as well as for learning reports, documentation, and exhibition purposes (within the studio). 

  • These are taken on a secure Whimsy & Co. Studio device and are not uploaded to any cloud storage or third-party services.

  • All images are stored safely and handled in accordance with privacy guidelines.

  • Media may be used for your child’s learning report (if included in your package) and stored securely for documentation purposes.

 

Photos and Videos

  • We ask families to provide consent for photography and video at enrollment.

  • Consent covers use of unidentifiable images for marketing, learning reports, exhibitions, and newsletters.

  • If you prefer your child not to be photographed or filmed, please notify us in writing, and we will do our best to accommodate your wishes. However, please understand that photo and video consent is required for learning reports. 

  • To protect the privacy of all children, parents/caregivers are not permitted to take photos or videos during class time. There will be a short opportunity at the end of each session for you to take photos of your child’s work and achievements.

 

Social media & Marketing 

  • We love sharing the joy of our studio, and may use unidentifiable images (e.g. backs of heads, hands, art-making moments) on our website, Instagram, and other marketing materials.

  • We will never post identifiable images of your child without your express written permission.

 

Excursions

From time to time, we may offer small excursions or off-site experiences that relate to the creative inquiry we’re exploring in class.

  • These excursions are designed to enrich your child’s learning and will always be thoughtfully connected to our studio themes.

  • Some excursions may incur a small additional fee, depending on the location, transport needs, or entry costs.

  • We will always:

    • Inform you in advance of any planned off-site activity

    • Seek written consent from parents or caregivers before your child attends

    • Provide details about timing, supervision, safety, and any associated costs

  • If you choose not to consent to your child attending the excursion, the class on that day will be considered skipped, and no refund or credit will be provided.

Participation in excursions is optional and only available to families who provide consent.

 

Holiday program T&C

  • Holiday program bookings are separate from term enrolments and must be paid in full upfront to secure a place.

  • Each holiday program booking covers one session only.

  • All policies outlined in the general Terms & Conditions (including illness, cancellation, and refund policies) also apply to holiday program bookings.

  • For detailed information on the holiday program schedule, duration, and activities, please refer to the Holiday Program Information available on our website or in the PDF provided at the time of booking.

  • We recommend reviewing all holiday program details carefully before booking.

 

Public Holiday Policy

If a class falls on a public holiday, that session will not run.

  • We do not offer make-up sessions for public holidays.

  • A discount will be applied to the term fee only for returning families who are re-enrolling for the following term.

  • New families joining in a term that includes a public holiday are not eligible for a discount, as enrolment is based on the remaining scheduled sessions.

 

Learning Report Policy

For families who choose the class package that includes Learning Reports, the following terms apply:

  • You will receive two personalised reports during the term:

    • Week 4 Report

    • Week 8 Report (End-of-term)

  • Each report will be thoughtfully written by a member of the Whimsy & Co. teaching team, never AI-generated.

  • Reports will include:

    • Written reflections on your child’s participation, creativity, and progress

    • A small selection of photos and/or short video clips of your child engaging in class (unlisted video links may be used for videos)

    • All content will be delivered as a PDF file to your nominated email address.

  • These reports are designed to give you a meaningful insight into your child’s experience, especially helpful for home educators or simply for memory-keeping.

  • Please refer to the Learning Report Example (available on our website or upon request) for a clear idea of what your report may include. Content and structure may vary slightly depending on each child’s experience.

  • Reports are included only in the packages that specifically state learning reports are part of the offering. They are not available as a standalone add-on at this stage.

 

Artwork & Exhibition

At Whimsy & Co. Studio, we deeply value the creative process and love celebrating the work your children produce.

  • We endeavour to hold a mini exhibition at the end of the term (usually in Week 9 or 10) to showcase the children’s art.

  • Some artworks may be temporarily held by the studio so they can be prepared or displayed in this exhibition. These works will be returned to your family after the exhibition is over.

  • In some cases, we may photocopy or scan your child's work for documentation, portfolios, or to display digitally, and then return the original to you.

  • If your child’s artwork is selected for display, we’ll take great care of it and make sure it gets back to you in good condition.

If you'd prefer for your child's original work to always be sent home immediately, just let us know and we’ll make a note on their file.

 

Privacy Policy

  • Whimsy & Co. collects personal information necessary for enrollment and communication.

  • All personal data is stored securely and used only for purposes related to your child’s participation and our communications.

  • We do not share personal information with third parties without your permission.

  • You may request access to your personal information or ask us to update or delete it at any time.

Unforeseen Circumstances/Force Majeure 

  • Whimsy & Co. is not liable for delays, cancellations, or interruptions caused by circumstances beyond our control, including but not limited to natural disasters, government restrictions, or emergencies.

  • In such cases, we will make reasonable efforts to notify families promptly and arrange refunds or credits where applicable.

Intellectual Property

  • All Whimsy & Co. creative content, including digital products, worksheets, patterns, logos, and marketing materials, are the intellectual property of Whimsy & Co. Studio.

  • Unauthorised copying, distribution, resale, or commercial use of our content is prohibited.

  • Permission must be obtained in writing for any use beyond personal or educational purposes.

 

What to Bring

Please ensure your child comes prepared with:

  • A named water bottle

  • A small snack (nut-free if possible)

  • Comfortable clothing that can get messy (we’ll be working with paint and other creative materials)

Late Pick-Up Policy

  • Classes finish promptly at the scheduled time. Please ensure you arrive on time to collect your child.

  • If you are running late, please contact us as soon as possible.

  • If pick-up is more than 5 minutes late on more than two occasions, a late fee will be charged from the third time onwards. 

  • If pick-up is more than 15 minutes late, a late fee will apply regardless of frequency.

Late fee structure:

  • $10 for the first 15 minutes late

  • $1 per minute thereafter

Our Creative Philosophy

Whimsy & Co. values the creative journey over the final product.

  • Children may not come home with a completed artwork after each session — and that’s completely intentional.

  • Our classes focus on exploration, experimentation, and developing artistic confidence, sometimes over multiple weeks.

  • We encourage you to celebrate the process and trust that your child is learning in meaningful, joyful ways.

 

Use of AI 

At Whimsy & Co. Studio, we believe in the value of human connection, creativity, and authenticity.

  • We do not use AI to write our Learning Reports or create our digital products (such as worksheets, or artwork).

  • All content is thoughtfully created by a member of the Whimsy & Co. Studio teaching team to ensure it reflects genuine care and insight.

  • We may occasionally use AI-based tools (such as Grammarly) only to check spelling and grammar, but never to generate or replace original writing or artwork.

Your child’s learning journey and your experience with our products deserve a personal, human touch, and we are proud to keep it that way.
