These Terms & Conditions (“Terms”) apply to all digital products sold by Whimsy & Co. Studio (“we,” “our,” “us”). By purchasing or downloading any of our digital products, you (“you,” “the customer”) agree to these Terms. Please read them carefully before making a purchase.

1. Nature of Products

• All of our digital products are delivered electronically.

• No physical product will be shipped.

2. Licensing & Usage

• Purchases are for personal use only, unless otherwise specified.

• You may not:

  • Share, resell, redistribute, or sublicense the files in any way.

  • Claim the work as your own.

  • Use the files for commercial purposes without prior written permission from us.

• Educators may use our resources in their own classroom or teaching practice, but may not share the files with other teachers or institutions unless an additional licence has been purchased.

3. Intellectual Property

• All designs, text, graphics, and content are the intellectual property of Whimsy & Co. Studio.

• Purchasing a digital product does not transfer ownership of copyright.

4. Payments

• All prices are listed in NZD and include GST where applicable.

• Payment must be received in full before the product is delivered.

5. Delivery

• Upon successful payment, you will receive an email with the product attached, or with a link to download your product (depending on the product).

• Please ensure you enter your email address correctly when purchasing.

6. Refunds & Exchanges

• Due to the digital nature of our products, all sales are final.

• We do not offer refunds, returns, or exchanges unless required by New Zealand consumer law.

• If you receive a corrupted or incorrect file, we will provide a replacement at no additional cost.

7. Technical Requirements

• You are responsible for ensuring you have the necessary software and devices to open and use the files (e.g., PDF reader, compatible apps).

• We are not responsible if your device or software is incompatible.

8. Limitation of Liability

• We are not liable for any damages, losses, or issues that may arise from the use or misuse of our products.

• Our maximum liability is limited to the purchase price of the product.

9. Changes to Terms

• We may update these Terms from time to time. Any changes will apply to future purchases and will be posted on our website.
